Clinical negligence or NHS complaint?

Understand the difference between an NHS complaint, professional regulation, PHSO investigation and a clinical-negligence claim, including outcomes, evidence and limitation risk.

An NHS complaint can investigate care, explain decisions, acknowledge fault and improve services. A clinical-negligence claim asks whether legally actionable breach of duty caused injury and financial loss. They are not the same test and do not produce the same remedy.

A complaint process should never be assumed to stop the court limitation clock.

Key points

  • You do not have to prove negligence to make an NHS complaint.
  • Poor outcome alone does not prove legal negligence.
  • PHSO is an ombudsman, not a court awarding damages.
  • Professional regulators protect the public rather than compensate the patient.
  • Obtain specialist advice promptly where injury or limitation may be significant.
