Medical records complaints

How to obtain and challenge medical records, distinguish factual inaccuracy from clinical opinion, request additions or corrections, and use NHS, data-protection and ICO routes.

Medical records disputes often contain two different complaints: what care was provided and what the record says about it. Keep them separate so the organisation cannot answer one while ignoring the other.

Data-protection accuracy does not require every professional opinion to be replaced because the patient disagrees with it. It does require personal data to be accurate as to matters of fact and appropriately qualified where accuracy depends on context.

Key points

  • Use a subject access request where you need the underlying record and audit material.
  • Identify each disputed entry by date, author, wording and claimed error.
  • Separate objectively wrong facts from disputed clinical judgement.
  • Ask for correction, annotation or a supplementary statement as appropriate.
  • The NHS complaint and data-protection routes can run in parallel but answer different questions.
