A school suspension or permanent exclusion has a specialist statutory framework. The school, governing board or academy trust, local authority and independent review panel have different roles. An ordinary council complaint is not the route for overturning an exclusion decision.
Key points
- Keep the exclusion notice and record the date received.
- The governing board’s role and the parent’s right to make representations depend on the type and cumulative length of exclusion.
- A permanent exclusion may lead to an independent review panel after the governing board decision.
- SEND, disability, safeguarding and reasonable-adjustment issues should be identified early and supported with evidence.
Decision route
Identify the decision-maker and next stage
| Issue | Decision body | Possible next step |
|---|---|---|
| Initial suspension or permanent exclusion | Headteacher | Representations and governing-board consideration where the framework requires or permits |
| Governing board upholds permanent exclusion | Governing board or academy trust committee | Request an independent review panel within the stated period |
| Alleged discrimination | School complaint and specialist Equality Act route | Consider First-tier Tribunal for disability discrimination or county court for other relevant claims |
| Council provision after exclusion | Local authority | Challenge education provision or administrative failure through the relevant route |
Notice and evidence
Audit the reason and procedure
- exact reason and date of each exclusion
- length of suspension and cumulative days in the term
- incident evidence and pupil account
- behaviour policy and provision relied on
- SEND support, EHC plan and reasonable adjustments
- safeguarding and contextual information
- governing-board papers and decision reasons
- deadline and address for the next challenge
Review
Prepare representations around the statutory questions
Address whether the headteacher’s decision was lawful, reasonable and procedurally fair, and whether relevant evidence was properly considered. State the outcome sought. If the pupil has SEND or a disability, explain the support in place, unmet need, reasonable adjustments and whether behaviour was connected to disability.
Independent review
An independent review panel reviews the governing-board decision
For a permanent exclusion upheld by the governing board, the decision letter should explain the right to request an independent review and the applicable deadline. The panel has defined powers and does not operate as an unrestricted rehearing. The current Department for Education guidance effective from 26 July 2026 should be checked directly.
Council role
Do not send every school dispute to the council
Maintained schools, academies and local authorities have different responsibilities. A council may have duties relating to education provision and arrangements following exclusion, but it may not control an academy’s internal complaint decision. Use the specialist exclusion route first and complain separately about administrative failures within the responsible body’s powers.
