NHS complaints advocacy and support

How free NHS complaints advocacy, Healthwatch, PALS and other support can help with an NHS complaint in England, and the limits of each service.

A person does not have to draft and manage an NHS complaint alone. Local authorities arrange independent health complaints advocacy, and local Healthwatch can help identify the provider in the area.

Advocacy is different from PALS, legal representation and the ombudsman. Knowing the limits prevents the consumer expecting the wrong service to investigate or decide the complaint.

Key points

  • Independent NHS complaints advocacy is free.
  • An advocate can help structure correspondence and attend meetings but does not decide the complaint.
  • PALS is mainly a hospital-based support and resolution service, not independent adjudication.
  • Healthwatch can explain local arrangements and signpost advocacy.
  • Specialist legal advice may still be needed for negligence, inquests or court limitation.
